Austin Wolf Granted Ninth Continuance on Child Pornography Charges

If you had forgotten about the whole Austin Wolf mess, we’re sorry to remind you about the disgusting case. The multi-award winning performer has been granted a ninth continuance.

Wolf, aka Justin Heath Smith, was arrested June 28, 2024 on child pornography charges. He is charged with one count of distribution and receipt of child pornography and one count of possession of child pornography. An FBI search of his apartment reportedly uncovered an SD card with “hundreds of videos containing child pornography.” Noted U.S. Attorney Damian Williams at the time: “As alleged, Justin Heath Smith received and distributed hundreds of recordings containing child pornography, including a ghastly video showing a young child bound, beaten, and raped.”

This week, a federal judge granted a ninth continuance. That puts the deadline for indictment or preliminary hearing at April 28.

“The Government has requested a continuance of 30 days to engage in further discussions with counsel about the disposition of this case and that the defendant, through counsel, has consented that such a continuance may be granted for that purpose, specifically consenting to an extension of the deadlines under Rule 5.1 of the Federal Rules of Criminal Procedure and 18 U.S.C. § 3161(b) for an additional 30 days. It is further found that the granting of such a continuance is for good cause shown and best serves the ends of justice and outweighs the best interests of the public and the defendant in a speedy trial.”

The order of continuance also notes that “Michael Baldassare, Esq. and Thomas Andrykovitz, Esq., counsel for defendant, and Assistant United States Attorney Getzel Berger have been engaged in, and are continuing, discussions concerning a possible disposition of this case.”

A conviction on distribution charges carries a mandatory five-year minimum sentence and a maximum of 20 years. Possession carries a maximum sentence of 10 years in prison. But it sounds like Austin Wolf might be in the process of negotiating a plea deal, perhaps giving the authorities more potential criminals to prosecute.
