The Australian Military Court has faced challenges to its legitimacy since it was established in 2007. Brian George Lane is the first military member to formally challenge the constituional legitimacy of the military court as he appeals to the High Court.
His case involves a scrotum and a forehead. At the end of a long day, Mr. Lane allegedly “placed his genitals on the forehead of an army sergeant who was asleep on a motel bed.”
An overturn of the military court’s resolutions on Mr. Lane’s case would create a legal nightmare for the military, The Age reports. The trial is well underway, as The High Court has already held a discussion and arrived to a consensus regarding the precise meaning of “tea-bagging.” (Seriously.)
