  2. You Americans have a fascinating, fatalistic, Calvinist perspective on everything that occurs in your country. It’s hysterical.

    Anywho, Stephen Reinhardt’s decisions are often overturn on appeal. Is it really surprising that a court in San Fran held Prop 8 unconstitutional, given Prop 8 was shot down in San Fran and around the entire bay area? No, not really. And there is nothing anti-democratic about the decision: polls already support a majority support gay marriage. Although, for the record, this is the only ruling to my knowledge that invoked the Federal Constitution equal protection clause on appeal (as opposed to the state constitution) to find a “right” to same sex marriage – 26 judgements in other states have found no such right. Let’s see how the Supreme Court rules (or alternatively, where the decision is review en blanc).

    Now I would have voted for Prop 8 precisely because the courts introduced it, not because I am opposed to gay marriage – judicial rulings such as these are an insult to the gay rights movement. What are you saying? That gays are so uncool, so unpopular, so pathetic and tepid, so elitist, so hated that we can’t even persuade 2.5% of the population to vote our way? The gay rights movement would have had unprecedented social legitimacy than no other gay rights movement if it had the vote approved by fellow voters. Not the Netherlands (curiously, a country without any judicial review). Not Sweden. Not Spain with 50% youth unemployment (because in these countries people speak to one another, rather suing one another). Fortunately, a ballot initiative to put gay marriage on the ballot later this year to do just that. If New Jersey, Rhode Island, Maryland had the ballot initiative they’d probably already have gay marriage!

    So the reality is the voters will probably introduce gay marriage before the courts do, and the whole appeal process will be rendered moot by the time it reaches the Supreme Court. And yes, America – there is this thing we call “contingency” – you can use democracy to change democratic decisions you believe are tyrannical (of course, not that rights operate ‘asymmetrically’).

    Personally, I don’t think the Supreme Court will find a right to same-sex marriage: it would be invalidating 45 statutes, which would simply be unheard of (generally there needs to be a nationwide “consensus” before courts take action). The court is too smart and it would actually set gay rights back several years as no doubt all the Southern States, and some in the West would introduce a constitutional amendment saying “Marriage is a state issue”.

Pub I’ve got to be completely honest, most of what you’ve written has gone right over my head, but it sounds like you might know what you’re talking about. One of those times when I’m smart enough to say…..I don’t know. I just hope that gays in all states may be able to be married sooner rather than later. God Bless Canad……I mean the USA

      1. Basically, you don’t need judicial oligarchy to help your cause (if anything, it damages the cause due to backlash). All you need is a ballot box, patience and a good argument (with some federalism thrown in). In short, do it like they do it in the Netherlands, Switzerland and Bavaria.
