The Latest HIV Criminal Is An Olympian

According to the New York Times, the 45-year-old athlete met a man online and fucked him a bunch over the course of a few months. Darren’s former boyfriend says that he ended the relationship after discovering medical records in Darren’s home that revealed his positive HIV status.

Chiacchia is from Florida, one of 36 states with a history of criminalizing HIV, and where his charges might land him in prison for 30 years. Prosecutors are currently culling evidence, which includes tape-recorded conversations and email transcripts. In one email message, Darren explains that he didn’t want to disclose his status because he didn’t trust his new boyfriend or want the information used against him.

Well, Darren’s mistrust was well-founded, because now a lovers’ quarrel between two consenting adults has landed in the hands of HIV prosecutors, who are eager to haul people’s sex lives into courts with a history of absurd and irrational convictions, as with the 35-year prison sentence a couple years ago of a Dallas man who spit on a police officer.  

It’s unclear where HIV criminalization will lead. Will HIV positive guys need to start wearing cowbells? Mandatory biohazard tattoos? And what about other diseases? Canada is prosecuting people who don’t disclose their herpes. And this one time I made out with a guy even though I had a cold. These kind of distinctions should be made by the adults having sex, not by prosecutors who are eager to legislate our sex lives.

To Darren’s former boyfriend I would say two things: assume that everyone you fuck is HIV positive, duh; and crying to the police makes you a pussy, okay?

  1. Ok yeah, lets shift the balance to HIV+ people in preventing the spread of infection by prosecuting them. Examine the GENIUS effects of this policy:

    1) People who think they might have HIV are terrified to get tested, because upon finding out it will become illegal for them to have sex (at least in the irrational mind of a person who is scared and un-counseled). So they’ll go untested so they can have sex without risk of arrest, and infect others.

    2) People with a false sense of security will put themselves at risk, thinking that their partner must be HIV- since lying is illegal (when in reality an unknown status is not a green light), and end up contracting HIV from people who did not know their status.

    3) People with HIV will be further stigmatized.

    4) People with HIV will be a persecuted class. Ironically, the HIV- people who most want to get cops involved – those at risk – will end up being members of the persecuted class if their risk leads them to test positive.

  2. i really can’t stand you american gays. most of you are hypocrites, nasty and so shallow that all the working out has made you lose complete compassion for your fellow man – let alone a gay one. In civilised countries we only prosecute people who intentionally infect others. And that one is has been restricted to one guy who espoused infecting other fags at a bathouse and for one African immigrant infecting uneducated women by insisting he not use condoms. Every gay guy knows the risks when you have casual sex. Protected or not. I only every had protected sex and one time I got a bit of blood on my finger and BAM – I am positive. So James, you cretan, I did not fuck up my life it was just a mistake. And in this world there are very few actions which mean a liftetime of punishment. Drunk drivers take out a whole family and are driving again in 10 years.

  3. People fail to realize is when you hook-up with someone , the purpose is to have fun and not catch a deadly diease..i have no respect for people who dont share their hiv status with someone…just because you fucked up your life doesnt mean someone else has to pay for it

  4. why does crying to the police makes him a pussy…he did the right thing..if you meet somebody and they dont tell you that they are hiv positive you should be punished for it. Hiv isnt anything to play with it’s a deadly diease that you can die from. Just because you were careless and got it doesnt mean the next person should catch it…..this is giving gay people a bad name as it is

    Where does it say they had unprotected sex? Where does it say he lied about his status and said he was negative, rather than just not discussing status? Where does it say that the (former) boyfriend got infected and is now positive? I don’t see any of that ANYWHERE in this post…

    If Chiacchia lied about his status and said he was negative, AND if he fucked the man without a condom, AND if that man is now positive, then yeah, he should face consequences. AND if you are hiv negative and want to stay that way, use a friggin condom when you fuck, or deal with the fact you may get infected. There are also people who honestly believe they are negative who are NOT, and they can get you infected just as easily.

    How about let’s stop the witchhunt before we have more facts, put down the burning torch for a minute, ok?

  7. That is a horrible thing to do, it’s downright criminal and I hope they prosecute his sorry behind for putting other people in harms way. Also, how could you meet someone on line and then have unprotected sex with them, come on now, be smarter than that. I agree with the boyfriend for turning him into the police, what he did is a criminal act. He knew he was HIV positive yet he kept it from his partner, I could see if he did not know, but he knew so he should pay the price. I say off to jail with him.
